  1. Can She Get My House? Custody of Our Children?(17-NOV-09)

I owned a Home and had custody of my two boy before my wife and I got remarried. We have only been remarried for about 4 years.

Does she have any right to the house and can she get custody of the boys if she leave me again?

  2. Should I Give Custody of My Child to My Parents?(11-AUG-09)

I need some advise on child custody. My ex-boyrfriend and I had a child together, and he left me after she was a week old. While we were together I was under the impression he was going to get a divorce and we were going to be married. This is his second child and his reason for leaving me was I didn't treat him good enough, which is fine, but he is now interested in being with an old friend of mine and our child is only a month old. I am worried he is to bouncy when it comes to people and want to have full sole custody of my daughter. I am not clear to work because of my c-section til the second week of August. Since I live with my parents and they are more able than her father and I, would it be best if my father filed for custody instead of me?

  3. Boyfriend Locked Away in Jail(02-JUN-09)

My boyfriend has been jailed for both criminal contempt and civil contempt for failure to appear for his child custody issue court date. They have sentenced him to serve 180 days PLUS to remain in jail until he pays the FULL amount he is in arrears!!!!!

Everyone says to get a good attorney, but I don't have that kind of money nor does he. He can't get legal aide because he is in jail. No one will talk to me unless I hire them, which I don't have money to retain them. Not only is he in jail 6hrs away from him home, but he is in a small town that his Ex and her family is very prominent. And the DA now, was Ex's attorney for divorce (good old buddy type town).

I have been told by some "new" attorney's that they don't know how to help him until they try to keep him beyond the 180 days. He can't address visitation modification and child support modifications until he is released. They tell me I should hire an experienced lawyer!! We can't even seem to get answer if they will release him after 180 days (June 20), or if they will keep him in there beyond until he pays full arrears!

How can anyone be indefinitely confined without given chance to work to make payments?

We offered Ex my tax refund ($1000) towards what he owes, if she would allow him to be released to start paying what he owes. She of course not only refused, but wants him to give up his PATERNAL Rights!

    PLEASE, ANYone help!!!

  4. Can I Make Dad Sign Divorce Papers?(05-MAY-09)

I am having a hard time getting custody/parenting papers signed with my ex. One of the hold ups is that he wants to claim our daughter on his taxes. Can he do this, is it normal? She will be with me 75% of the time.

Also in regard to child support. He is not claiming all his income (he claims pt income) also, he gets a monthly GI bill for school, will the state factor that into the order amount? Finally how do I go about making him verify his income?

  5. Changed custody, but in name only. How to get back to reality?(24-MAR-09)

A little over a year ago I agreed to change primary custody of our child to the father in hopes he would then take a more active role. It backfired on me and nothing changed. As of today and from the date custody was changed I still have our child 90% of the time. I do all school pick ups and drops off's as well as the child living in my residence 90% of the time. I would like to have the custody changed back but he refuses. What should be my next step?

  6. Do Moms Always Get Custody of the Children?(27-JAN-09)

What does Florida law state regarding custody of a child of an unmarried couple? Does the mother automatically obtain custody?

  7. Can Absent Mom Get Equal Time Parenting?(09-SEP-08)

My ex-wife lives in Florida and I live in Canada. She left 6 years ago and has not seen our 10 year old son in 3 years. Whenever I bring up the topic of child support she threatens to go to court to take my son to live with her 6 months out of the year so she won't have to pay. Is it possible that a judge would grant this and make my son go live with her when he hasn't seen her in 3 years and she only calls once every couple of months? She reminds me all the time how the United States court system isn't the same as Canada's. My son is also a special needs child (ADHD), in counseling and sees a specialist every 3 months. We do have joint custody but I am the primary care giver. Are her rights abolished since she abandoned him 6 years ago?

  8. Messages Left By Ex Upsetting Children(27-MAY-08)

I have been married for 6 years and have 2 children (4 and 1) and a step daughter who is 12. The biological mom has no legal visitation/access; my husband has full custody. My question is the mom is constantly leaving threatening messages saying that if we don't comply with her wishes my husband will "burn in hell" and now my 4 year old has nightmares that her daddy will catch on fire in his sleep. She is now saying that she is moving in next door to us to keep an eye on us and her daughter. My marriage is now hanging on by a thread and my children are being affected mentally. Can I get a restraining order on her for me and my 2 small children?

  9. How Can I Get Child Custody Back?(29-APR-08)

I left my husband 3 years ago, taking my two kids with me, after a few months we tried to work out our marriage and so I let him take my youngest daughter to stay with him over the weekends, until now I have not been able to get my daughter from him. He would always want us to visit them in their house and I can't take my youngest with me anymore. He locks the gate in their house whenever we're there. I made a couple of scene in the past because of these incidents. My daughter is now 5 years. I'm afraid that she's growing up without me around all the time. She's lived there now and I'm afraid she might not want to come with me anymore since she learned to love the people there. I can't take her out of the house, my husband is afraid that I'm going to take her and will not bring her back; which is really what I'm going to do. In the first place, he did this when I only allowed him to spend the weekends with his daughter. He took full responsibility without my consent.

  10. Dad's A Semi-Deadbeat; Can New Husband Adopt Children?(26-FEB-08)

My ex husband and I have been divorced for 7 years and we have a daughter who is 9. He has paid child support only because it is taken out of his check by the state. Every time he switches companies, 4 times this year, there is a long intentional delay in support payments. Just recently, he relocated out of state from Illinois to Portland, violating his visitation and joint custody agreement. We have a court order stating he is supposed to have her 3-4 days a week but now he moved 2,000 miles away. He hasn't paid anything in over 4 weeks for child support. Is there something I can do to enforce his visitation or can my husband now adopt her since my ex hates paying support and moved so far away?

  11. Can We Reverse An Adoption?(12-FEB-08)

If you adopt a family member's child, can the natural parent receive custody again? The adopt parent and natural parent agree to it and everyone agrees that it's in the best interest of the child. How would we go about getting information?

  12. Will I Be Able To Get My Child Back?(05-FEB-08)

I am a single parent who wants to go in the army. I have to turn custody over to my daughter's father to do this. Will it be difficult for me to get her back once I'm in for about a year and a half? Here is some information on him: He was released from prison 1 year ago and is currently on probation. Will it be difficult for me to get her back if he fights to keep her?

  13. Where To File To Modify The Divorce?(01-JAN-08)

If a military couple divorces in Alabama and subsequently moves to different states (Texas and Florida), what are the procedures for revisiting the visitation rights of a parent? The mom, living in Texas and custody of the children (ages 15 and 12) wants to contest the visitation rights of the father, now living in Florida. Can she file a petition in Texas?

  16. Do I Have To Pay All The Travel Cost To See My Child?(17-APR-07)

My exwife and I divorced 5 years ago. We have two children which I pay only child support for one because the one child turned 18. I had to move to another county (75 miles round trip) because my company relocated. We have joint custody but for the last five years I have done all of the travel as opposed to when we lived in the same city. I love to see my child but the expense of travel is all mine now. Is this the common practice?

  17. Custody And The Child's Preference(10-APR-07)
My son is presently residing with his father. He is now 11 years old and has made it known to me that he would like to reside with me. How old is a child required to be in order to be heard by a judge?

  18. How can I keep my child safe?(20-MAR-07)

My ex-husband and I share joint custody of our 9 year old son. I have primary placement and he sees our son every other weekend. I have repeatedly asked him not to drive with our son on the back of his motorcycle. He is now doing so against my wishes. I feel very strongly about this, this is the only thing I have asked of him. What recourse do I have, if any?

  19. Does "Fault" For The Divorce Affect Joint Custody?(13-MAR-07)

If I file for divorce and I am at fault. What are the chances of getting joint custody of my child?

  20. Adoption And Moving(13-MAR-07)

I have 2 children with my ex-boyfriend; the children are now ages 11 and 9. He has not seen them since 1999 and at that point my children where 3 and 1 1/2 years old. I have sole custody of the children he does not see them or pay child support for these two children.

I was married in 2000 and my husband has been supporting my two children as well as our two children that we have together. Right now we live in New York but my husband might be getting a job offer in Florida. Do I need to file something with the court or can I just move to another state since my ex-boyfriend does not see the kids and we do not know where he is? Even his mother does not know where here son is and my ex-boyfriends parents are very much involved in their grandchildren's lives.

Also, my husband would like to adopt my 2 children from my previous relationship but some people said I have to have the biological fathers permission to terminate his name from the birth certificate before he can adopt - is this true? What do I need to do about both situations? Thanks.

  21. How Can We Get Custody Of Our Deceased FriendÂ’s Children?(30-JAN-07)
I have a friend whose children have lived with me on and off for about 7 years. As of two years ago he sent them to live with me and my husband permanently. He was a single parent with custody of his children. Last week he took his life. He left behind three children two of which are minorsÂ’ ages 11 and 16. Neither side of the family (mothers/fathers) has been involved in their life for over 5 years. Their mother is currently incarcerated and not expected for release until 2026. Is there a way we can get guardianship over these children? My husband and I have fully supported them for the last 2 and 1/2 years including everything from housing to medical to schooling. Any information would be greatly appreciated.

  22. Can I Gain Custody Of My Daughter?(16-JAN-07)
I just found out that I have a daughter that is five. I got to meet her and she stayed a week with me. Her mother does not have custody her grandma does. What are my rights as far as keeping her? My daughter tells me when she is here, and when on the phone, that she doesn't want to go back to her grandma's. I have three kids that I work and take care of and I would like to have my other one. I am paying child support and I have insurance on her.

  23. Can I Change Custody?(19-DEC-06)
My divorce was final in May and we have joint custody of our two children, ages 2 & 4. I have primary placement. She is not required to pay child suppport and does not choose to see them either. Over the last six months she has seen them less than 15% of the time each month. She continually lets the kids down by saying she will be there and not showing. Orignially they told me I couldn't take her back to court for 2 years after the divorce was final. That is too long to wait. She is doing emotional damage to my 4 year old son and I want to take her back to court now. I don't want her money but I want her to either have less cutody or no custody. What can I do?

  24. Shortchanged On Child Support(24-OCT-06)
My divorce is final 10/06. I had to agree on less child support so the father can fly in from Louisiana to see his son. I agreed only because I could not take it any longer, nor did I have the money to proceed. Can I do something to get the 17% child support that I should be getting? They said if I did not it would cost 20k because he was threatening to go to a trial even though the judge said it would not make a difference in the custody (he's military). Thank you. I hope someone can help me.

  25. Ability To Move When There Is No Contact And Inadequate Support(03-OCT-06)
My ex-husband and I got a divorce. My daughter lives with me and he has visitation every other weekend and has to pay $600+ every month for child support. About four months ago he called me one day and told me that he didn't want to see her anymore and he has not called since then. He is also only paying $48 a week. Can I take him back to court to get full custody of her so he has no visitation and so we can move?
