Education and Credentials

Ms. Drake graduated, magna cum laude, Phi Beta Kappa, Phi Kappa Phi from the University of Utah in 1974 and later graduated from the University of Utah Law School in 1979. She served as a member of the Panel of Trustees, U.S. Bankruptcy Court for the District of Utah from 1981-1983. She has also served as the Chairperson of the Bankruptcy Section of the Utah State Bar (1985-1986) and was a founding trustee of the Utah Bankruptcy Lawyers' Forum from 1990-1992. Ms. Drake has been admitted in the United States District Court for the District of Utah and the United States Tenth Circuit Court of Appeals.

Scope of Practice

Throughout her career, Ms. Drake has represented creditors in all aspects of the bankruptcy practice, including filing claims, suing debtors to declare certain debts nondischargeable or to deny the debtors a discharge, acting on behalf of creditors in connection with confirmation of Chapter 11, 12 and 13 plans, and representing creditors who become defendants in preference or fraudulent conveyance lawsuits. Her debtor experience includes representing consumer and business Chapter 7 debtors, defending debtors in dischargeability litigation, and representing family farmers in Chapter 12 and troubled businesses in Chapter 11. Ms. Drake has also been involved in a number of successful out-of-court workouts and has represented receivers in state court receivership proceedings.
