Defense of a Federal Judge:
United States v. Aguilar: Patrick Hallinan and Hugh Levine successfully defended U.S. District Judge Robert P. Aguilar in his first trial in 1990, on charges of racketeering, obstruction of justice, and disclosure of wiretap information. In an eight-week federal trial, they secured an acquittal on one count and hung jury on the remaining counts. Innovative attacks Mr. Levine brought against the wiretap disclosure count in Judge Aguilar's first trial ultimately were adopted by the Ninth Circuit Court of Appeals in reversing his conviction on that count during his second trial.
Defense of Corporate Officers:
People v. InFerGene Company, Inc. et al.: A biotechnology corporation, its president and house counsel were charged by a state prosecutor with multiple felony counts of environmental offenses arising from disposal of radioactive and other hazardous medical waste. As lead counsel for the corporation, Mr. Levine obtained the dismissal of all charges at the preliminary hearng.
Demolishing a Frame-Up:
A businessman was driving home from work when his car was stopped by police, who were acting on an anonymous trip that the car contained narcotics. Cocaine was found under the driver's seat and the man was arrested and charged with drug offenses. Exhaustive defense investigation revealed that the man's wife was having an affair with a drug dealer, and that the cocaine had been planted at her behest. Faced with the results of the defense investigation, the prosecution dismissed all charges on the eve of trial.
