Financial Services and Securities

• Represented global bank through pretrial and obtained settlement of $100+ million claims involving insurance of securitized bonds. (2010-2012)

• Defended and obtained settlement on $30+ million fraud, tortious interference and negligent misrepresentation claims on behalf of a global real estate firm by tenant-in-common investor group. (2010-2012)

• Regularly represented national broker/dealer via arbitration or settlement of numerous multimillion-dollar securities claims over failed mutual funds. (2009 through present)

• Prosecuted and obtained settlement on $75 million mortgage buyback dispute for global bank. (2006-2008)

• Arbitrated $29 million reinsurance dispute for regional insurance company against international reinsurer. (2005)

• Represented regional property and casualty insurer prosecuted multimillion-dollar D&O policy claims; settlements substantially exceeded policy limits and attorneys' fees. (2001-2004)

• Represented "Final Four" accounting firm in real estate securities litigation, obtaining complete and repeated summary judgments. (1992-1998)

Complex Business Systems

• As both plaintiff and defendant, regularly represent multibillion-dollar global consumer products company in disputes over manufacturing systems, vendor supply, operations and distribution; most resolved without litigation. All resolved without trial. (2001 through present)

• Represented global telecommunications supplier in $70+ million dispute with wireless carrier; obtained resolution within 90 days. (2011)

• Defended software integration firm against $15mm+ data security breach claims through pretrial and settlement. (2011-2013)

• Prosecuted and settled multimillion-dollar defective component claims against vendor on behalf of global HVAC manufacturer. (2008-2010)

• Argued appeal of reversal of $90 million trial verdict to 1ST District Court of Appeals in Houston concerning surety bonding of two natural gas processing plants, resulting in partial reversal for client. (November 2009)

• Represented a surety in a 4-1/2 month jury trial of $185 million dispute of SPE financing and construction of multi-state, multi-facility gas processing project. Obtained summary judgment on owner bad faith claims. Obtained verdict for surety for in amount of $20 million actual and $70 million exemplary damages against project owners. (2006)

Intellectual Property Protection

• Represented global telecommunications equipment supplier in pursuing breach of non-compete and trade secret theft claims against breakout group and competitor. Resolved without trial and within sixty days. (2012)

• Obtained settlement after taking over representation of avionics client in multimillion-dollar claims alleging theft of aviation technology trade secrets. (2007)

• Represented patent holder of ophthalmic surgical implant defending competitor's infringement claims: obtained summary judgment. (2003)

Various

• Lead counsel in two-week trial in federal court in Camden over manufacture of Stetson and Resistol cowboy hats. (1996)

• Obtained settlements on behalf of numerous National Football League players in contract and other disputes with the Dallas Cowboys and other NFL teams, repeatedly defeating team summary judgment efforts. (1992-1998)

• Represented NFL players challenging the constitutionality of Ohio's worker's compensation statute. (1994-1996)

• Defended musician Stevie Ray Vaughan in multimillion-dollar contract dispute with former manager: settled and released for no money. (1990)

• Represented real estate developer in lender liability action against now defunct savings and loan association, resulting in a $150 million verdict after three-months of trial. (1988)
