    Representative Matters: Victor v. ACH, ___ F.4th ___ (2026). The Sixth Circuit Court of Appeals affirmed the grant of judgment as a matter of law in favor of the defendant health care corporation on negligence claims brought under section 1983, after a jury verdict in favor of the plaintiff at trial. The Court held that witnesses' testimony that they cannot recall whether an event occurred is not sufficient to create a genuine issue of material fact as to the occurrence of that event.
    Duncan v. Liberty Mutual Ins. Co., 854 Fed. Appx. 652 (2021). The Sixth Circuit Court of Appeals held that a plaintiff has no st
    ing to recover 'double damages' from automobile insurer under Medicare Secondary Payer Act, where the plaintiff cannot establish any concrete injury due to a claimed delay in Medicare reimbursement.
    White v. Hutzel Women's Hospital, 498 Mich. 881 (2015). After the Court of Appeals reversed a judgment in excess of $800,000 for plaintiff in a medical malpractice action

    ed the case for a new trial, the Supreme Court, on further appeal by the hospital, granted the hospital's request for additional relief
    issued an order directing entry of a judgment notwithst
    ing the verdict in the hospital's favor.
    Doe v. Henry Ford Health System, 306 Mich. App 592 (2014). In a case of first impression, a putative class action involving claims of electronic data breach, the Court of Appeals reversed the grant of class certification
    held that summary disposition should have been granted, concluding that there was no viable action for invasion of privacy or negligence because there was no intentional conduct or present injury.
    Meier v. Awaad, 299 Mich. App 655 (2013). In a case of first impression in a case involving a request for class certification, the Court of Appeals rejected the plaintiffs' attempt to obtain the names
    addresses of nonparty patients of the defendant physician by sending a subpoena to a third party payor of the medical bills, the Michigan Department of Community Health. The Court reaffirmed the broad scope of the physician-patient privilege by holding that the privilege continues to apply even after privileged information has been disclosed to a third party that is not a health care provider.
