Bill Elliott Rivera (Immigration Law Counsel) born New York, N.Y., September 25, 1953; admitted to bar, 2006, Florida. Education: Lehman College of the City University of New York (B.A.); Fordham University School of Law (J.D.). Bill E. Rivera is a determined and committed attorney that has dedicated his belief in the service of others to his legal practice in immigration law. Litigation in the Immigration Court is his chosen practice area and is, at the same time, the result of his decision to pursue a new challenge. Bill opted for both a change in geography and profession by relocating to Orlando, FL from Chappaqua, NY in 2003 and transitioning from his former job as a Sergeant in the New York City Police Department to a second career as a lawyer. As a native New Yorker who now considers himself a Floridian, Bill has successfully transformed himself into a lawyer who focuses on defending clients in the Immigration Court. In 2004, Bill volunteered his services to the immigration law office of the not-for-profit Catholic Immigration and Refugee Services of the Diocese of Orlando, FL. His legal training and Spanish speaking skills were much needed for a client population that was primarily Hispanic and in dire need of legal assistance. Soon thereafter, Bill was offered and accepted a position as a staff attorney and quickly found himself immersed in the fascinating details of refugees from every part of the world including Africa, Asia, the Middle East, Eastern Europe, Latin America and the Caribbean. Family based immigration related petitions were very much a part of his legal work, but his advocacy for clients primarily involved litigation within the context of asylum, deportation and general removal proceedings in the Immigration Court. Four years later, Bill moved on to private practice, but has not moved away from his enthusiasm for litigation in the Immigration Court and continues to maintain the same commitment to work in the service of others. Committed to the notion of community service, Bill has participated in local Orlando, FL radio programs where he responded to the immigration questions of the radio listener. He has also spoken before various religious, community and business groups in Central Florida regarding their relevant immigration issues. Topics have included family related petitions for legal permanent residency, immigration consequences of criminal convictions, citizenship applications, affirmative and defensive asylum applications and I-9 compliance. Bill has developed a strong skill set through many years of practical work experience and academic accomplishment that has and will serve his clients well. His ability to interview effectively, listen accurately, negotiate convincingly, analyze and synthesize information and think quickly under pressure have all been tested over time in the New York criminal justice system and the rigorous academic environment of a Jesuit law school. Today, advocacy drives his practice in immigration law and every client he serves can be assured of having an attorney that is well versed in the complexity of the Immigration Court. Reflecting on his initial interest in immigration law as a student at the New York Fordham University School of Law, Bill's practical legal experience in Florida convinced him that exclusively practicing immigration law was the right choice for him. Reflecting on his relocation to Florida, he is more than aware that the northeast suburbs of New York are radically different from the Florida he now knows, but the sun drenched neighborhoods of Orlando and the natural beauty of the Sunshine State have made him feel very much at home. Accomplishments: Staff Editor, International Law Journal of Fordham University School of Law. Recipients: Fordham University School of Law Public Interest Law Award; Golden Key National Honor Society; English Literature Honor Student; New York City Council Citation; Police Relief Fund Plumsock Award. Member: American Bar Association; American Immigration Lawyers Association. Languages: Spanish. Practice Areas: Immigration and Naturalization; Asylum; Deportation; Family Immigration Law; Political Asylum; Refugee Law; Removal Proceedings; Permanent Visas; Employment Immigration; Litigation.Email: Bill Elliott Rivera
Mary E. Fitzgibbons (Litigation & Health Law Counsel) born Park Ridge, Illinois, May 26, 1967; admitted to bar, 1995, Florida; 1996, U.S. District Court, Middle District of Florida and U.S. Court of Appeals, Eleventh Circuit. Education: Northwestern University (B.A., summa cum laude, 1987); University of Michigan (M.A., 1988; J.D., 1991). A former Felony Prosecutor and Judicial Clerk for the U.S. Court of Appeals, Ms. Fitzgibbons focuses her practice in the area of criminal litigation and appeals, family litigation, business law and litigation (including franchising) and health law and litigation. In private practice, Ms. Fitzgibbons has represented over 50 physicians nationwide in litigation with the government and private individuals. She has extensive experience in franchising and business litigation and has lectured for the Florida Bar on the enforcement and defense of non-competition agreements. In addition, Ms. Fitzgibbons assists health law clients with various issues, including but not limited to business formation, medical board proceedings and compliance issues. Often, Ms. Fitzgibbons' criminal and family law cases are complex and involve high- conflict, medical, psychological or forensic issues, expert testimony, domestic injunctions, child kidnapping and/or allegations of abuse. One of her best-known criminal cases was the successful post-conviction defense of Alan Yurko, where the court released Yurko from prison after serving seven years of a life sentence in connection with the tragic, sudden death of his infant son due to exposure to alleged "hot lot" vaccine and natural causes. Ms. Fitzgibbons finds that oftentimes the issues confronting her clients in the business and domestic arena are quite similar and that frequently, accusations of civil or even criminal misconduct may arise. In today's world, a business breakup can present issues as challenging and as stressful as any divorce. The key to success in any new venture (be it buying a franchise, hiring a physician, or "tying the knot") is due diligence and smart contracting before the relationship ever becomes finalized. Also, pre-litigation planning is essential. If you are about to put your life on the line in a new business or personal venture, or you have found yourself in the middle of a civil or criminal dispute involving complex issues and/or high-conflict dynamics, Ms. Fitzgibbons invites you to contact her.
