Visitation Rights



Visitation is the legal term for the right of a non-custodial parent to visit a child or children. Typically, the non-custodial spouse has legal visitation rights to child visitation or parenting time unless the family court finds that visitation is not in the best interest of the child. States vary in their approach to visitation and child visitation rights; although, it generally consists of alternating weekends and some holidays.

The visitation schedule is stated in the final divorce agreement and may be modified by further court order. I recently found out the child i have been taking care of for 5 years is not mine through dna testing. I informed the mother (eventhough im pretty sure she knew) she ran down to the court and filed to take me off child support and the legal rights with visitations and decisison making. Husband appointed a guardian of his property which everything we own is in his name but the home we live in, he has memory problems and his daughter without our knowledge applied for guardianship and was appointed, we have been married 18 years this year, I am his caregiver and have been for the past 2 years, but I have been totally cut off from all support from him, I dont have any funds to hire an attorney to help me with support. I have the papers support unconnected with divorce, but I do not know how much support to ask for, my husband has an annuity (IRA) that we have lived on since we were married that is around $ 275,000.00 and motor home, cars etc are worth about $60,000.00. My question is should I ask for 1/2 of everything or 1/3 , my husband was retired when we married and I worked up until 2005. We live in Florida.
